Car crash - No MOT, still Insured??

    Hello,

    Before you ask no I haven't wrapped the Golf round a tree! But my Uncle did have a crash last night, it was his fault and he pulled out on a brand new VW Fox in his Rover 75 (I tried to tell him he could have atleast pulled out on a Corsa and rid the world of another one instead of a VW lol)

    His car looks like a possible write off but I didn't get to see the Fox so not sure about that...but when he got home last night he realised that his MOT ran out at the end of July. Will this meen that he won't be insured? I said to him that unfortunately I was pretty certain they would walk away from a claim on his car but he might at best be insured 3rd party to cover the other person that he pulled out on.

    What do you think? Could he maybe face not getting paid out for his car and also the insurance not paying up for the other person too resulting in 6 points for driving without insurance?

     some insurers will pay out only if it can be proved that the crash was not due to not having an mot eg bald tires or worn brakes that would have been picked up on when having an mot

    Arr dear, not the answer I am sure he want's to hear but is as I thought.

    What about 3rd party insurance though? Will he be covered for that, if she puts in a whip lash claim too?

     I've said it and I will say it again why the f**** cant they send out a MOT reminder just like the road Tax....  Maybe it doesnt genera\te enough income for the plebs....

    Its only in the last two or three years that the MOT has been computerised so maybe they haven't got the systems in place yet ....

    That said I have to fully agree with you on it.  Insurance renewals and tax reminders are sent out so why not the MOT, especially now its computerised.  It COULD be because they dont have it fully linked to the DVLA database with current registered keepers etc

    I used to get one from Vauxhall. I only took imy car there once and they reminded me for years afterwards.

    I'm pretty sure your insurance is invalid without an MOT.

    If it doesn't fit, spit on it and try again.

     If you read the terms and conditions of the insurance it should say something along the lines of;

     

    Blah de blah, cover is only valid provided you're car has a valid U.K   M.O.T test certificate, failure to comply may/will render you're policy invalid.

    Its all in the wording but I know that you can drive a car without an MOT but with insurance providing you are going to an MOT station.  Its worth digging it out and having a read.  You should have all the small print with your certifcate etc

    All down to MoT Station I suppose - mine sends me the wife and my son a reminder 1 month before it's due. It's all to do with ingenuity and wanting your custom every year.

     Uninsured.

    The big question is, will the insurer check? With Jonny-no-stars in a Corsa, almost certainly. With a codger in a 75? Maybe not.

    If they do discover this, all you can do is hope that they are in a good mood, and decide to let it slide, but don't expect them to.

     A guy at work was in a similar situation, although knew he had no MOT, They ended up paying out.

    I would have rather they didn't pay out in his particlular case but can understand how easy it is to forget about MOT time.

    Sorry to hear that mate. 

    The bad news, I'm afraid, is that his insurance will be invalid.  He could also be charged for driving without insurance if this is the case...

     2 options as I see it. Keep quiet and plead ignorant, or find someone who knows an MOT tester and get them to pencil it in the book as coming in for an MOT today and say he was dropping it off the night before. Might work if needed?

     it all depends if the car is a write off the insures will ask for the mot,log book, if they decide to repair it they will not(in many cases) ask for it. but having said that if they want to be akward and get out of paying out then they will look for any excuse.

    Same here for me on a recent scrape in a car park (not my fault). My car did have a vaild MOT though but I was not asked for it. I'd keep shtum until it comes up.

     ive had write offs and minor work done through insurance and none of the times have i been asked for an MOT cert.

    as said, i think if you keep quiet, you might be lucky and they wont notice. for the last 2 years, my MOT has run out by about 2 weeks before i realise, i dont do it on purpose, both times ive had it done the day i realise and its passed both times

    Think it will be a case of it being  uninsured - as for reminders I get a text from the stealers I got my car from a week or so before mine is due so I can book it in at the independant place down the road form the office to get it done and delete their reminder usefull as it is tho Smile

    Thanks for all the replies guys! Just got to wait now and see what happens. I think that the car is going to be repaired so fingers crossed the insurance will pay out and lesson learnt!

    I guarantee that they will check such things and use them to get out of paying out. They will do anything to get out of forking out. All info is logged on a database now, just like the one the DVLA uses online to check your MOT and insurance when you apply for a tax disc. I suspect it is probably the first thing they do when they get a claim through...

    Where does the black in Guinness go when you wee wee? I mean, how can something blacker than a black night with the consistency of used engine oil come out crystal clear within 20 minutes after 10 pints?

    We do this, more to try and get the business before someone else does, but many small IMTs don't have even simple databases to do such a thing sadly.
